Veranstalter des Gewinnspieles ist die Johann.Strauss-Festjahr2025 GmbH, Doblhoffgasse 9/13, 1010 Wien, die MuseumsQuartier Errichtungs- und BetriebsgesmbH, Museumsplatz 1, 1070 Wien und der Wiener Tourismusverband, Invalidenstraße 6, 1030 Wien.
Die Teilnahme am Gewinnspiel ist von 20.02. bis 06.03.2025 möglich.
Mit der Teilnahme an dem Gewinnspiel erklären sich die Teilnehmenden ausdrücklich und verbindlich mit den folgenden Gewinnspielbedingungen einverstanden.

Die Teilnahme am Gewinnspiel erfolgt durch Folgen der Instagram-Accounts @johannstrauss2025, @mqwien, @vienna und @jazinthecity, sowie Kommentar unter dem Gewinnspielbeitrag.
Teilnahmeberechtigung
Teilnahmeberechtigt sind alle unbeschränkt geschäftsfähigen Personen, die zum Zeitpunkt der Teilnahme das 18. Lebensjahr vollendet haben. Der Instagram-Account muss für die Gewinnbenachrichtigung ein öffentliches Profil sein. Die Teilnahme am Gewinnspiel ist kostenlos. Von der Teilnahme ausgeschlossen sind Mitarbeiter:innen des Johann.Strauss-Festjahr2025 GmbH, MuseumsQuartier Errichtungs- und BetriebsgesmbH, Wiener Tourismusverband und Jaz in the City Vienna und deren Familienangehörige sowie alle Personen, die an der Konzeption und Umsetzung des Gewinnspiels beteiligt sind.
Gewinnermittlung
Unter allen teilnahmeberechtigten Personen, die teilgenommen haben, wird der der:die Gewinner:in einem unabhängigen Losverfahren ermittelt.
Gewinnbenachrichtigung
Nach der Gewinnermittlung wird der:die Gewinner:in via Direktnachricht auf Instagram verständigt. Im Gewinnfall benötigte Lieferdaten werden ausschließlich für den Gewinnversand genutzt.
Sofern sich der:die Gewinner:in nicht innerhalb von 24 Stunden ab Erhalt der Gewinnverständigung meldet, verfällt der Gewinn. Das Gleiche gilt für den Fall sollte ein:e Gewinner:in keine oder falsche Kontaktdaten hinterlegen.
Datenschutz
Die Teilnehmer:innen des Gewinnspiels erklären sich damit ausdrücklich einverstanden, dass deren eingegebenen Daten (Name, E-Mail-Adresse, Telefonnummer), die im Falle eines Gewinns bekanntzugeben sind, auf den Kommunikationskanälen von Johann Strauss 2025 Wien (Website, Social Media) bzw. zur Kontaktaufnahme verwendet werden dürfen. Für die Richtigkeit der angegebenen Kontaktdaten sind die Teilnehmer:innen verantwortlich. Die Teilnehmer:innen erklären sich damit einverstanden, dass ihre Daten von Johann Strauss 2025 Wien für eigene Marketing- und Werbezwecke bis zur Abwicklung der Gewinnvergabe gespeichert und verwendet werden können. Der:Die Teilnehmer:in kann seine:ihre Zustimmungen jederzeit schriftlich mit einer E-Mail an marketing@jost25.at widerrufen und somit von der Teilnahme am Gewinnspiel zurückzutreten.
Vorbehaltsklausel
Die Veranstalter behalten sich das Recht vor, Teilnehmer:innen bei Verstößen gegen diese Teilnahmebedingungen, falschen Angaben, Beeinflussung des Gewinnspiels durch unlautere Maßnahmen oder Manipulationen jeglicher Art zu jedem Zeitpunkt ohne Vorankündigung von dem Gewinnspiel auszuschließen bzw. einen Gewinn ersatzlos zu annullieren und zurückzufordern. Die Veranstalter behalten sich vor, rechtliche Schritte einzuleiten. Aus dem Ausschluss bei Vorliegen berechtigter Gründe entstehen keinerlei Ansprüche der Teilnehmer:innen gegenüber den Veranstaltern.
Diese Teilnahmebedingungen können jederzeit ohne gesonderte Benachrichtigung adaptiert bzw. geändert werden. Die Veranstalter behalten sich weiters ausdrücklich vor, das Gewinnspiel ganz oder in Teilen aus wichtigem Grund ohne Vorankündigung zu unterbrechen oder zu beenden (wie etwa bei technischen Fehlern, Missbrauch o.Ä.).
Eine Barablöse des Gewinns ist nicht möglich. Die Angaben sind ohne Gewähr. Der Gewinn ist nicht übertragbar und gilt ausschließlich für den:die Gewinner:in. Der Rechtsweg ist ausgeschlossen. Auf die vorliegenden Teilnahmebedingungen findet österreichisches Recht unter Ausschluss der Kollisionsnormen des internationalen Privatrechts und des UN-Kaufrechts Anwendung. Ausschließlicher Gerichtsstand ist das für 1010 Wien jeweils sachlich zuständige Gericht.

Terms and Conditions of the Contest: Bat Day
The organizers of this contest are Johann.Strauss-Festjahr2025 GmbH, Doblhoffgasse 9/13, 1010 Vienna, MuseumsQuartier Errichtungs- und BetriebsgesmbH, Museumsplatz 1, 1070 Vienna, and the Vienna Tourist Board, Invalidenstraße 6, 1030 Vienna.
Participation in the contest is possible from February 20 to March 6, 2025.
By participating in the contest, entrants expressly and bindingly agree to the following terms and conditions.

Participation in the contest is completed by following the Instagram accounts @johannstrauss2025, @mqwien, @vienna, and @jazinthecity, as well as commenting on the contest post.
Eligibility
All individuals with full legal capacity who have reached the age of 18 at the time of participation are eligible to enter. The Instagram account must be public for prize notification purposes. Participation in the contest is free of charge. Employees of Johann.Strauss-Festjahr2025 GmbH, MuseumsQuartier Errichtungs- und BetriebsgesmbH, Vienna Tourist Board, and Jaz in the City Vienna, as well as their family members and all persons involved in the conception and implementation of the contest, are excluded from participation.
Winner Selection
The winner will be selected through an independent random draw from all eligible participants.
Prize Notification
After the draw, the winner will be notified via direct message on Instagram. Any delivery details required for prize fulfillment will be used solely for that purpose.
If the winner does not respond within 24 hours of receiving the notification, the prize will be forfeited. The same applies if the winner provides incorrect or incomplete contact information.
Data Protection
Participants expressly agree that their submitted data (name, email address, phone number), which must be provided in case of winning, may be used for communication via Johann Strauss 2025 Vienna's channels (website, social media) and for contacting them. Participants are responsible for the accuracy of the provided contact information. Furthermore, participants agree that their data may be stored and used by Johann Strauss 2025 Vienna for its own marketing and promotional purposes until the contest is completed. Participants may withdraw their consent at any time by sending an email to marketing@jost25.at, which will result in their withdrawal from the contest.
Reservation Clause
The organizers reserve the right to exclude participants from the contest without prior notice if they violate these terms and conditions, provide false information, manipulate the contest in any way, or use unfair methods to influence the results. The organizers also reserve the right to take legal action. Participants have no claims against the organizers in the event of exclusion for valid reasons.
These terms and conditions may be adapted or changed at any time without prior notification. Additionally, the organizers expressly reserve the right to interrupt or terminate the contest in whole or in part without prior notice for important reasons (e.g., technical errors, misuse, etc.).
Cash redemption of the prize is not possible. The information provided is without guarantee. The prize is non-transferable and valid only for the winner. Legal recourse is excluded. These terms and conditions are governed by Austrian law, excluding conflict-of-law provisions of international private law and the UN Convention on Contracts for the International Sale of Goods. The exclusive place of jurisdiction is the competent court in 1010 Vienna.
